Abstract- The right to listen (the child) is something of a cross right to the other: the premise to the promotion and realization of all areas of well-being, because listening enhances relationships and promotes social growth. The child should be informed, heard, and “must” participate in his social and family context, and the adult should be able to help the child to express a free consent in specific psycho-emotional conditions. The listening of the child right to work as a genuine “respiratory organ” of the legal system, because it can restore the vitality that is physiologically own and to adapt to the natural becoming of social phenomena. Therefore, think about the right to be heard of the child is definitely a way to understand the reasons behind the real phenomenology, with respect to which the right, first saggy and folded in formalistic drift, now seems destined, moved by the need to keep in step with the evolution.
