Abstract – Carl Schmitt is one of the most controversial political and legal thinker of the last century. By the ideological point of view he played a key role during the Nazi regime, defending the Führer and fighting against democracy and political liberalism. Around this figure in the last period of his life and after his death a mythical halo arose, continuing to play his influence on many thinkers. An accurate reflection on his famous concepts reveals how inconsistent and even wrong they are, but above all how still dangerous they could be especially in such a time as this.
