Abstract: Climate change and its disastrous consequences are the most current and pressing issues that States must now address. However, international agreements on climate change have so far been non-binding. They, therefore, did not factor in either precise obligations or adequate sanctions against participating States. Even the Paris Agreement on climate change of 2015, just like the United Nations agreements that preceded it, has not been able to stop the climate crisis that is currently underway. To solve the problem we should take inspiration first of all from European Union legislation in terms of atmospheric emissions and, then, from the Italian one, since they both contain precise rules and an accurate sanctions system of both administrative and criminal nature.
