ABSTRACT – Rights of public use are subject to strict discipline, which imposes stringent constraints, preordained to safeguard the collective use of land. The Regions, however, are trying to weaken the foregoing constraints and this leads to a conflict in the area of the division of legislative powers. The rulings issued by the Constitutional Court offer an opportunity to car-ry out problematic considerations, in relation to different profiles of the matter.
