Abstract – The phenomenon of B&Bs within condominiums is now booming; however, this is a «fashion», not always compatible with the residential use of the condominium buildings and the condominium regulations, whose conflicts can be resolved in the light of an adequate balance between the interest of the owner, the existential interest of the person and the interest of the condominiums, as happens in the French legal system, where the Court of Cassation trough a recent ruling has inaugurated a new deal.
