Abstract – The protection of cultural heritage is entrusted, in the Italian system, to a complex system of rules, which often arouse application uncertainties and, therefore, solicit the search for adequate reconstructive criteria. In this context, the European norms are generally given a limited importance: some recent legislative measures offer, however, an opportunity to rethink the role of European law in the matter.
