I migranti ambientali e climatici: inquadramento del fenomeno e tutela dei diritti umani

 ABSTRACT – This paper proposes a reflection about the phenomenon of migrations related to environmental or climatic reasons, and which is the object of growing attention in the scientific-academic debate mainly due to its evident and constant expansion in quantitative terms in contemporary society. After an initial statistical overview of the phenomenon, the paper focuses on the forms of recognition of the legal subjectivity of the environmental and climatic migrant, proposing an inclusion of the figure, and the related protection’s needs, within the legal-philosophical category of “vulnerability”, understood here in a situated perspective, and, therefore, valuing the jurisdictional moment in the work of making the protection of human rights concrete.
