ABSTRACT – In this article, we aim to analyze the relationship between dominant cultures and minority cultures, and to examine how to navigate this relationship through the lens of criminal law, understood as a tool of social control against those who engage in social practices different from those of the state in which they reside. The core issue posed by multiculturalism is encapsulated in this simple question: how should conduct authorized by a certain cultural identity but prohibited by other cultures be considered? More specifically, how can we identify a criterion capable of resolving the conflict? Finally, this contribution aims to analyze the applicability of the restorative justice model to so-called culturally oriented crimes in light of the Cartabia Reform.
