ABSTRACT – Deflation is one of the key objectives of the Cartabia reform, resulting essential for the modernization of the penal system and the fight against prison overcrowding that affects Italy since late seventies. The contribution, starting from a historical analysis of the institute, examines the recent changes made within the discipline of the trial suspension with probation, highlighting the innovative aspects and critical issues, reflecting on the possible problems in application site as well as the lack of regulatory coordination with the alternative measure of the assignment on probation.
