ABSTRACT – In legal semantics, the expression “probatio diabolica” indicates the need for evidentiary rigorism that has found affirmation especially in the field of property claim action. The paper examines its multiple implications, under the profiles of the relativization of subjective situations in concrete cases, of the attenuation of the rigor of proof in certain cases and in the perspectives offered by new technologies.
