ABSTRACT – The paper analyses the sovereignty in the process of European integration, as the essential element of the State connected to the doctrine of counter limits. Being inspired by the jurisprudential process of integration through the rights, the focus is on the double prejudiciality following the Taricco case and it is concluded that the European integration is not in crisis, at least until the tools of guaranteeing the rule of law are used reasonably.
