ABSTRACT – The essay analyses the relationship between law and violence as conceived by Freud in his correspondence with Einstein concerning war. The thesis argued here is that, for Freud, violence – understood as Todestrieb – is actually what drives men to seek peace. Paradoxical as it may seem, in fact, the death drive is ultimately at the service of civilisation (Kultur) and men’s inclination to pacifism.
