ABSTRACT – The main aim of this paper is to illustrate the way in which the Italian Code for Business Crisis and Insolvency extends the concept of consumer in law. That way ultimately consists in restricting a possible area of penumbra of that concept, and that code does so by employing a definition of the term ‘consumatore’ partially different from the definition of the same term used in the Italian Consumer Code. If the latter definition were used in the former code, one would have to deal with more borderline references of the term ‘consumatore’ than the borderline references of the same term that depend on the use of the other definition.
