ABSTRACT – With the sentence n. 71/2020 the italian constitutional Court censored the art. 53 of the law n. 34/2010, made by the Calabrian legislator, that provided for the declassification of funds encumbered by civic uses in- cluded in industrial development plans, without a rigorous examination of compatibility with the needs of a landscape-environmental nature. Besides it invades the civil system reserved to the exclusive legislative power of the State.
