 ABSTRACT – This paper proposes an analysis of the phenomenon of penal populism with the aim of highlighting the criticisms raised by the increasingly frequent use of criminal law at the level of the democratic balance. We will focus on the risks of an authoritarian turn in the systems that practise forms of penal populism, as well as on the controversial trilateral relationship it establishes between criminal law, public ethics and criminal justice.
