Rileggendo Satta: procedura secolare ed etica nel prisma della giustizia

DI DOMENICO BILOTTI

ABSTRACT The aim of this essay is to revisit the moral contribution of the Italian jurist Salvatore Satta to enlarge the scientific field of private law procedures by including in his exegetical analyses comparative suggestions concerning the evolution of criminal law and philosophical elements taken from an erudite vocational education. It fundamentally means to recognize a theological scholastic approach, a particular interest in both positive civil law and Canon law history, a meditatively conservative political prose, a compassionate humanist overview especially expressed in (but not limited to) Satta’s narrative works. This way to rediscover the otherwise somehow forgotten scholar will demonstrate the partial and inappropriate belief about the irreconcilability between secular reformism and religiously based ethics: Satta fruitfully walked both sides of the idea of legal judgment
