Abstract – The Pica Act and the Peruzzi Act introduced a rather harsh and moot exceptional legislation to counteract the brigandage in Southern Italy between 1863 and 1865. In particular, these acts governed the new crime of brigandage and assigned jurisdiction to military courts of justice. The first part of this paper analyzes both the parliamentary debate that led to their approval and their legal content. The second part analyzes the application of this legislation to a real case of abetment to the crime of brigandage in Calabria.
