ABSTRACT – This paper examines the issue of liability for the use of artificial intelligence systems in the light of current legislation and from a “de iure condendo” perspective. In this regard, the Author questions whether specific legislation is actually necessary and whether the path taken within the EU Directive proposal was the most appropriate one.
