Dallo scontro all’incontro: la mediazione penale minorile tra tutela e auto responsabilizzazione del minore di Marjane Orsi Hila
Abstract- This paper means to focus on victim-offender mediation as response to youth crime. According to the restorative justice’s approaches, a criminal act is an offense against a victim within the context of a community, as opposed to a violation against the state. Thus, a criminal act engenders a conflict among people and harms the victim; justice cannot be achieved unless the conflict is solved and harm repaired. Based on this view, the offender along with other individuals affected by the criminal act actively participate in the resolution of the conflict, with the help of a fair and impartial third party. It is rooted in shared values of solidarity, reparation, and a sense of justice, while it holds the promise of becoming an effective measure to reduce and prevent youth crime and to increase citizens’ sense of security.
