ABSTRACT – This paper focuses on the relationships between penalty regulation and negotiating autonomy in a system where the principle of numerus clausus and the prohibition of taking the law into one’s own hands suggest to consider the hypotheses of private self-protection to be exceptional. Hence, after a short examination of the functions referable to the institution of the penal clause, it follows an inquiry on the meaning of the so-called pure penalty and the limits to the definition of atypical civil sanctions.
