ABSTRACT – The work starts from a decision of the Court of Palermo which, through a shared methodological approach that looks at the concrete conformation of the facts and above all at the value expressed by them within a system pervaded by the principle of solidarity, comes to apply the rules dictated on the subject of mandatory relationships also to the real relationships.
