ABSTRACT – In this work the concept of thanatological damage is analyzed as configured in the Italian legal system and by the sentences of the Court of Cassation that have followed one another from 1925 to today. This work also focuses on the judgment of the Italian Court of Cassation, United Sections, n. 15350 of 22 July 2015 and on the issue of compensation in the event of culpable death as an immediate consequence of the damage caused by an unlawful act, on the courageous Scarano judgment n. 1361/2014 and on the transmissibility to the heirs, to be ascertained case by case, of the terminal biological damage and the non-pecuniary damage, so-called formido mortis.
