ABSTRACT – The present work aims to describe the framework of fundamental economic freedoms, through a brief historical and legal analysis of their impact on the Integration process. We will examine some ideas developed around the concept of economic constitution and its possible applications. Finally, we will focus on the possibility that the European architrave has conditioned the European legal-political system, creating an essentially negative form of integration and, as a consequence, a sort of hegemony of the economic over the political.
