La tutela giuridica dei migranti ambientali

ABSTRACT – Although there is no empirical evidence on the relationship between global warming and forced migration, a heated doctrinal and jurisprudential debate is looming over the type of legal protection applicable to these forms of migration. On the one hand, there are those who intend to extend the Geneva Convention to protect this type of migration, on the other, there are those who see complementary legislation as the only tool that can be envisaged. Starting from the scientific evidence, this paper has the objective of offering an overview of the topic, focusing attention on the suitability or otherwise of the current system to provide adequate and consistent protection spaces to the phenomena in progress. Finally, a transversal reflection will be reached on the possible interpretative keys outlined in the future.
