Teoria del reato e scienza penale nella dottrina di Giuseppe Bettiol. La logica concreta tra giusnaturalismo classico e teleologismo metafisico

ABSTRACT – Between the 1930s and 1950s, the criminalist Giuseppe Bettiol
devoted a great deal of attention to the dogmatic and methodological
problems of criminal science, elaborating a general theory of crime
analytically tripartite but hinged on a notion of formal and ethicalsubstantial
anti-juridicality, as well as advocating, in terms of method, the
adoption of a concrete logic oriented in a realistic and teleological sense. The
present study aims at analysing comparatively Bettiol’s theory of crime and
concrete logic, searching for their common philosophical matrixes and trying
to discern how each of them relates to the epistemological statute of
criminal science and to the emergence of a classically characterised natural
law.
